These Terms of Service (“Terms”) govern your access to and use of the services provided by Nomad Luxury Properties LLC (“Nomad”, “we”, “us”, or “our”), including property management, marketing, booking coordination, maintenance, and related short-term rental management services (collectively, the “Services”).
By using our Services, signing a management agreement, or accessing our website (www.nomadlp.com), you (“Owner” or “Client”) agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not use our Services.
Nomad provides full-service management and marketing of short-term rental properties on behalf of property owners. Services include, but are not limited to:
Nomad operates under an exclusive management model, meaning the Owner agrees not to rent or manage the property through other entities or individuals during the term of the management agreement.
Nomad’s standard commission for property management is 20% of the gross rental revenue collected.
Additional service fees may apply as defined in the executed Management Agreement, including but not limited to:
All payments are made monthly, on or before the 5th day of each month, via bank transfer to the account designated by the Owner.
The Owner must ensure that the Property:
Nomad shall not be responsible for structural defects or major repairs (including foundation, roofing, plumbing, or electrical systems). These remain the sole responsibility of the Owner.
Nomad may perform or coordinate property maintenance, cleaning, and minor repairs as needed.
Guest Damage Protection:
Nomad shall provide the Owner with a monthly statement showing all income, expenses, and deductions.
Rental proceeds, minus Nomad’s commission and applicable fees, shall be remitted to the Owner by the 5th day of the following month.
Nomad reserves the right to withhold or deduct from Owner’s proceeds any amounts due for maintenance, repairs, utilities, or other authorized expenses related to property operation.
The Management Agreement operates on a month-to-month basis and may be terminated by either party with 30 days’ written notice via email.
Upon termination:
Nomad acts solely as an agent and manager for the Owner.
Nomad shall not be liable for:
The Owner agrees to indemnify and hold harmless Nomad, its members, agents, and employees from any claims, damages, or expenses (including attorney’s fees) arising from property ownership, maintenance, or rental activities, except in cases of proven gross negligence or willful misconduct by Nomad.
The Owner is responsible for maintaining appropriate homeowner’s and liability insurance covering short-term rental use. Nomad may request proof of insurance at any time.
The Owner also agrees to comply with all condominium, HOA, city, county, and state regulations governing short-term rentals.
Nomad will maintain the confidentiality of all Owner financial, personal, and property-related information obtained during the course of management, except as required by law or as necessary to perform its duties.
All marketing materials, photographs, descriptions, and creative content produced by Nomad remain the intellectual property of Nomad Luxury Properties LLC and may be reused or repurposed for promotional purposes.
Nomad Luxury Properties LLC (“Nomad”) may, in its capacity as authorized property manager and agent for participating property owners, utilize managed properties for limited promotional and marketing purposes, as expressly authorized under the applicable Property Management Agreement.
Such promotional use may include temporary occupancy by marketing partners, media professionals, digital influencers, artists, content creators, or other collaborators for purposes of content creation, brand exposure, and strategic partnerships.
All promotional use:
Individuals occupying a property for promotional purposes are deemed guests of Nomad, not of the property owner. Nomad implements reasonable damage protection measures, including security deposits, insurance coverage, or contractual safeguards, but does not guarantee coverage for all losses. Property owners remain responsible for structural integrity and insurance coverage as outlined in the Management Agreement.
Property owners acknowledge that promotional use constitutes a marketing benefit designed to increase property visibility and long-term rental performance and agree that no rent, compensation, or credit shall be due for such promotional stays.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any dispute or claim arising out of or related to these Terms or Nomad’s Services shall be first attempted to be resolved amicably through good-faith negotiation.
If no resolution is reached, disputes shall be submitted to binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.
Nomad reserves the right to modify these Terms at any time. Updated versions will be posted on our website and become effective immediately upon publication. Continued use of Nomad’s Services after such updates constitutes acceptance of the revised Terms.
